CBD Oil: What Is It And Who Can Legally Use It

A bill proposed for this legislative session would legalize CBD oil for all Hoosiers.  It could also answer questions about what it is and who may use it.

Purdue University botanist Janna Beckerman agrees there is confusion about the substance that is extracted from the cannabis plant.

“When we talk about CBD oil what we’re talking about is an extract, similar to how we get mint oil by distilling it from mint,” says Beckerman.

Indiana Attorney General Curtis Hill says the sale or possession of CBD – a marijuana derivative – is largely illegal in the state, except in very limited circumstances.

The legislature passed a law in 2014 legalizing industrial hemp. And in the 2017 session, lawmakers authorized the use of CBD oil, an extract from cannabis and hemp, to treat some epileptic conditions.

For at least the fifth time, State Sen. Karen Tallian (D-Portage) says she plans to introduce legislation that would reduce the penalty for marijuana use.

Three times a Tallian-authored bill that would have completely decriminalized marijuana use failed to clear the Senate.

This year marks the second time she’s written a law making the drug usable only for medicinal purposes.
