7th Circuit Stays Gay Marriage Ban Decision Again

Same-sex couples in Indiana still aren’t able to get married as a federal appeals court continued to freeze the effects of its ruling striking down the state’s gay marriage ban until the U.S. Supreme Court can weigh in on the issue. 

When a federal district court judge ruled in June that Indiana’s ban on gay marriage was unconstitutional, the Seventh Circuit Court of Appeals halted that ruling until it could hear the case. 

Earlier this month, the Seventh Circuit struck down the ban, but kept the previous stay in effect, anticipating that the case would move forward to the U.S. Supreme Court. 

After Indiana appealed the ruling to the Supreme Court, the Seventh Circuit issued another stay Monday.  That ensures Indiana’s gay marriage ban remains in place until the Supreme Court rules on same-sex marriage. 

Indiana Attorney General's Office spokesman Bryan Corbin says the stay prevents chaos and confusion until the case is conclusively decided. 

Hoosiers Unite for Marriage coordinator Kyle Megrath says the stay was expected and hopes the country’s highest court takes up the issue of same-sex marriage in its term that begins next month.
